Terms of Service

  1. Services

    We are a cryptocurrency payment processor. We enable you to accept cryptocurrency as payment for goods or services and process cryptocurrency payments you receive from your customers (purchasers).   2. Registration

    4. Our right to refuse

      If we have reason to believe that a sale violates these Terms or will cause harm to you, another merchant, purchaser or other party We reserve the right to refuse to process that sale.     5. Our inspection rights

  4. Third Party

    Through the use of the Services, we may post your company name, URL, artwork, text, logos and other publicly available information about your business on FissionPay> 's promotional materials and all marketing channels with your company name, URL, artwork, text, logo and other publicly available information about your business ('Merchant Content'). Third parties may use FissionPay> 's Public Merchant Content and customize the data to create entries in directories or other channels, and data listed on third-party directories or channels will be subject to separate third-party terms of use. You represent and warrant to us that you have the right to provide us with Merchant Content, and that our use, copying, modification and distribution of Merchant Content:(a) will not infringe, violate or misappropriate any third party copyright, patent, trade secret or other proprietary right, (b) will not infringe any right of publicity or privacy, and (c) will not be defamatory or obscene or otherwise violate any law.

  8. Checkout & Settlement
    1. Fee generation and exchange rate guarantee

      FissionPay's hosted checkout UI or API should be used. To charge your purchasers, you can send a request to FissionPay. FissionPay will pull the exchange rate, if applicable, and provide you with payment instructions to show to your purchasers. For any payments made using a supported blockchain, we consider the checkout complete after the payment has been confirmed by a reasonable number of blocks or the blockchain is designed to finalize the transaction. FissionPay is not responsible for payment settlement fees for payments for which sufficient block confirmations are never received.

    2. Fees
      1. Merchant fees : During FissionPay Fees are deducted during checkout activities on the platform (e.g., when checkout is completed).
      2. Buyer's fees : Cryptocurrency transactions may require miner fees. These miner fees are automatically created by the purchaser's wallet and sent to the miner. These miner fees are not FissionPay fees. Miner fees paid to the network are not refunded when a refund is performed.
    3. Settlement Method

      We will verify the buyer's payment and post the balance to your accounting ledger via the cryptocurrency peer-to-peer payment network according to your preferences. The debit and credit sides of your ledger are FissionPay funds held temporarily until they can be settled to your crypto wallet. You can use your local currency, any supported cryptocurrency, or a mix of both to obtain settlement. You bear the risk of fluctuations in the currency you choose to settle in. For example, if you choose to settle in Bitcoin, then you bear the risk of fluctuations in the value of Bitcoin.

      1. Settlement in Local Currency : Merchants located in certain countries/regions may use local currency for direct deposit to their bank accounts. If you wish to receive a direct deposit settlement, you must provide us with valid bank account information. They will charge you the applicable wire transfer fee. Settlement may be made from a bank account that starts with FissionPay or from a bank account held in the name of a legal anchor we work with. We are not responsible for any delays in receiving funds or incorrect bank account entry caused by third parties.
  9. Payment Exceptions

    In some cases, payment exceptions will result when an invoice is not paid in full, is overpaid, or contains incorrect or missing meta information. You can resolve payment exceptions from the FissionPay merchant dashboard to resolve payment exceptions. If the buyer requests a refund due to a payment exception, FissionPay will deduct the anchor fee from the refund amount.

    1. Underpayment An underpayment occurs when the buyer sends less than the full amount needed to mark the invoice as paid. Since the invoice is not paid in full or is not completed, the funds are not applied to your merchant ledger.
    2. Overpayments An overpayment occurs when an invoice receives excess funds. In this case and when no conversion is required, you will be paid in full.
    3. Certain extensions

      If we need to conduct an investigation or resolve any outstanding disputes related to your FissionPay account, we may delay settlement or restrict access to your funds during that time. In addition, we may delay settlement or restrict access to your funds if required by law, court order, or law enforcement.

    4. Account Information

      You will have access to account information detailing your ledger and transaction and billing history through your merchant account.   10. Account termination
    1. Your right to close your account

      These Terms apply only for the duration of your use of the Services. Once you stop using the Services, these Terms will no longer apply, and subject to Section 13.11 (Survival). You will still be required to pay us any fees incurred prior to the closure (if applicable) and we will remit to you any funds that have not yet been paid to you and that relate to the pre-closing sale. If your account balance falls below the minimum transfer amount we have recorded, you may be responsible for any applicable transaction fees that may be incurred in the transfer of funds.

    2. We have the right to close or suspend your account

      At our discretion, we may terminate your account after notifying you by email or phone. If we suspect that your failure to comply with these Terms pose an unacceptable risk of fraud to us, or if you provide any false, incomplete, inaccurate or misleading information We may also suspend your access to the Services.     You agree to indemnify FissionPay, its affiliated and related entities and any of their officers, directors, employees and agents from and against any claims, costs, losses, liabilities, damages, expenses and judgments of any kind (including, but not limited to, costs, expenses and reasonable attorneys' fees) arising out of, relating to, or in connection with any claim, complaint, suit, audit, investigation, inquiry or other proceeding initiated by or relating to a person or entity: (a) any actual or alleged breach of your representations, warranties or obligations set forth in these Terms; (b) Your wrongful or improper use of the Services; (c) products or services sold by you through the Services, including, but not limited to, any false advertising, product defects, claims for personal injury, death or property damage. (d) Any other party's access to or use of the Services through your account information.

  12. No Guarantee
